This Warranty (the “Warranty”) is issued by CCDS (the “Company”) and applies solely to restorations fabricated and sold by CCDS under the CCDS name (the “Product”). This Warranty is extended exclusively to Products from the Company.

1. Warranty Period

The Company warrants the Product against defects in material or workmanship for a period of six (6) months from the date of invoice (the “Warranty Period”).

2. Scope of Warranty

Subject to the terms and conditions set forth herein, in the event that the Product fails due to a defect in material or workmanship during the Warranty Period, CCDS agrees to reimburse the customer for the cost of the Product, upon receipt of proof of the invoice price, at no additional charge to the customer.

3. Eligibility

In order to be eligible for the benefits of this Warranty, the customer must: a. Provide written notice to CCDS within seven (7) days of discovering the failure of the Product. Such notice must include supporting documentation that clearly describes the circumstances and facts surrounding the alleged failure of the Product.
b. Ensure that there are no outstanding balances due to CCDS at the time the claim is made under this Warranty.

4. Exclusions

This Warranty shall not apply in the following circumstances: a. If the failure of the Product is due to trauma, accident, or damage caused by the patient or any third party;
b. If the Product is placed in a patient with pre-existing conditions, contraindications, or other factors that would reasonably interfere with the successful integration of the Product, including, but not limited to, diseases such as alcoholism, uncontrolled diabetes, or habitual drug dependency;
c. In the event of normal wear and tear of the Product over time, or other factors not directly attributable to a defect in material or workmanship.

5. No Other Warranties

Except as expressly stated herein, CCDS makes no other warranties, either express or implied, with respect to the Product. Any implied warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose, are expressly disclaimed to the fullest extent permitted by law.

6. Warranty Claim Process

To initiate a warranty claim, customers must follow the steps outlined below:

a. Claim Submission:
To submit a warranty claim, the customer must contact CCDS via email or through the provided online warranty claim form on the website. The customer must include the following supporting documentation:

• Photographs of the defective Product.

• A detailed description of the failure and circumstances surrounding it.

• A copy of the invoice showing the original purchase price and date.

• Any other relevant information that can assist in verifying the claim.

b. Inspection and Approval:
Upon receipt of the claim, CCDS may require additional information or request that the customer send the defective Product back for inspection. CCDS reserves the right to inspect the product to confirm the defect and determine the cause of failure. In certain cases, CCDS may ask for the Product to be returned before proceeding with a resolution.

c. Resolution Options:
After verifying the warranty claim, CCDS will resolve the issue based on the severity and nature of the defect. Possible resolutions include:

• Repair: If a defect is confirmed and repair is deemed feasible, CCDS will repair the Product at no additional charge to the customer.

• Replacement: If the Product cannot be repaired, CCDS may replace the defective Product with a new or equivalent product, provided the warranty claim is valid.

• Refund: If neither repair nor replacement is possible, CCDS will issue a full refund of the original purchase price, upon receipt of the defective Product and verification of the claim.

7. Non-Transferability

This Warranty is non-transferable and is valid only for the original purchaser of the Product.

8. Limitation of Liability

CCDS’ liability under this Warranty is limited to the purchase price of the defective Product. In no event will CCDS be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or in connection with the use or inability to use the Product, even if the Company has been advised of the possibility of such damages.

9. Force Majeure

CCDS will not be liable for any delays or failure to perform under this Warranty due to causes beyond its reasonable control, including, but not limited to, acts of God, fire, floods, pandemics, labor disputes, or governmental actions.

10. Dispute Resolution

Any disputes under this Warranty shall be resolved through arbitration, and shall take place in Palm Beach County, Florida.

11. Severability

If any provision of this Warranty is deemed invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.

12. Acknowledgement

By purchasing and using the Product, the customer acknowledges and agrees to the terms and conditions of this Warranty. The customer agrees to follow the instructions provided by CCDS for proper use and maintenance to ensure the Product’s longevity and performance.

13. Warranty Updates

CCDS reserves the right to update or modify this Warranty at any time. Customers will be notified of significant changes to the Warranty via email or through an announcement on the Company’s website.
